§ 21-58. Repair of leaks.

  • (a)

    Duly authorized agents or employees of the town having proper credentials shall have the additional authority to enter onto private property for the purpose of effecting repairs to remedy sewer leaks exposed by smoke tests or other scientific tests.

    (b)

    Authority to enter onto private property to effect repairs shall be effective only after the private property owner of record and those in possession thereof have been given sufficient notice of not less than thirty (30) days to repair the leaks at the owner's expense and have failed or refused to do so.

    (c)

    If the owner fails or refuses to repair the leaks pursuant to notice as aforesaid, the town shall have a lien on the property for the reasonable value of the labor and materials which it incurs to effect the repairs.
