§ 5-9. Construction site waste control.

  • (a)

    Operators of construction sites are required to control waste such as, but not limited to, discarded building materials, chemicals, concrete truck washout, litter and sanitary waste which, if not controlled, have the potential to enter storm sewers, ditches, wetlands, or ponds which the town maintains or retains ownership of for the public good. Construction site waste controls that will prevent waste from entering storm sewers, ditches, wetlands, or ponds which the Town maintains or retains ownership shall be shown or described on development drawings submitted in support of building permit applications. Applications may be rejected for showing insufficient controls or held in abeyance until they are amended by submitting drawings with sufficient controls.

    (b)

    The failure to follow or implement approved waste control measures may be prosecuted in the same manner as misdemeanors are prosecuted, treated as a civil code violation and enforced accordingly, or enjoined by a court of competent jurisdiction.
